This site and the mobile applications and services available in connection with this site and mobile application (the "App," and our "Services") are made available to you by Kidsanity LLC, a limited liability company registered in California, United States of America. The Powderline brand (and to whom these Terms apply) is made up of different legal entities including Powderline, Powderline Pod, Powderline Stoke, Powderline Shred, Powderline Perks and Kidsanity LLC. This Privacy Policy is issued on behalf of the Powderline group of companies so when we mention "Powderline", "we", "us" or "our" in this Privacy Policy, we are referring to the relevant company in the Powderline group of companies responsible for processing your data.
We respect your privacy and are committed to protecting your personal data. This Privacy Policy will inform you as to how we look after your personal data in connection with your access to or use of our websites, apps, products and services (including without limitation Powderline's domains and subdomains, forecasts, Powderline Stoke, Powderline Shred, Powderline Pod and Powderline Perks) (collectively, the "Services"). It also tells you about your privacy rights and how the law protects you.

This Privacy Policy aims to give you information on how we collect and process your personal data under applicable privacy and data security laws through your use of our Services.
Our Services are not intended for use by children, meaning individuals under the age of 16, and we do not knowingly collect data relating to children.
It is important that you read this Privacy Policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This Privacy Policy supplements other notices and privacy policies and is not intended to override them.

Changes to the Privacy Policy and your duty to inform us of changes
We keep our privacy policy under regular review and make changes from time to time and will take appropriate measures to inform you as required by applicable data protection laws. To see when this Privacy Policy was last updated, please see the "Last Updated" date above. Please come back from time to time for the latest information on our privacy practices.
Your continued use of the Services after any updates to this Privacy Policy take effect will constitute acknowledgement and (as applicable) acceptance of those changes. If you do not want to acknowledge or accept any updates to this Privacy Policy, you may cancel your account and stop using the Services.

Third-party promotions and services and links
From time-to-time we partner with third parties to provide you with products, promotions, giveaways, sweepstakes or other experiences. We will take measures to notify you and may show you the privacy policies belonging to those third parties, when third parties will receive information in connection therewith. Their privacy policy will govern the collection of your personal data, in addition to this Privacy Policy.
Our websites and apps may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you and any information collected by them is subject to that third party's own privacy policies. We do not control these third-party websites and services and are not responsible for their privacy policies. When you leave our websites and apps, we encourage you to read the privacy policy of every website or service you visit.
2. The Data We Collect About You
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
- Standard Identity Data includes name, alias, address (including zip code), email, phone number, marital status, date of birth, and gender.
- Profile Data includes username, password, account type, and any additional information you choose to enable your use of the Services such as general location, profile photo, marketing and communications preferences, interests, preferences, surf experience, lifestyle information, support communications, feedback, reviews and survey responses.
- Transaction Data includes details of products and services you have purchased from us. Your financial information is collected and stored by our third-party payment processing company (currently Stripe, Inc.). - Technical Data includes internet protocol (IP) address, device ID, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, browsing patterns, history, referral source, search terms leading you to our Services, operating system and platform, and other technology on the devices you use to access our Services.
- Usage Data includes information about how you use our Services and information that you provide including the length of time spent using any of our services, the frequency of your use of the Services or any portion thereof, photographs, videos, comments, or other data you may upload, and any meta data contained therein.
- Promotions, Sweepstakes, and Contest Data includes any information you provide to us in connection with any promotions, sweepstakes and/or contests that we run.
- Sensitive Personal Data includes (i) precise geolocation, physical movements, and health data in connection with use of Powderline Shred and (ii) identification documentation for identity verification. This data will only be collected and processed where it is necessary and where you have provided consent.
Identity Verification Data
We use Stripe for identity document verification. Stripe collects identity document images, facial images, ID numbers and addresses that you provide as well as information about the devices that connect to its services. Stripe shares this information with us and uses this information to operate and improve the services it provides, including for fraud detection. If you would like to request deletion of your data, we suggest reaching out to Stripe at privacy@stripe.com. Connected Devices/Accounts Data
We enable you to connect your Powderline account with third parties (i.e., devices, apps or accounts that integrate with the Services). We may, with your consent if you enable the connection, collect information from the third-party devices and accounts to facilitate interaction with our Services. Information collected by these third parties is subject to their terms and policies.
Ski Resort Data
Powderline may partner with ski resort operators (a "Resort Partner") to provide related services at the Resort Partner's property. Your ski or snowboard sessions may be captured on resort cameras installed at such properties and shared on our Services. Still or video images captured by cameras installed at Resort Partner properties may constitute Standard Identity Data to the extent visitors are recognizable and will be used in accordance with this Privacy Policy.
Aggregated Data
We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity.
If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.
3. How Is Your Personal Data Collected?
We use different methods to collect data from and about you including through:
Direct interactions
You may give us your Identity Data, Profile Data, Transaction Data, Promotions Data by filling in forms or by corresponding with us through the Services, by post, phone, email or otherwise. This includes personal data you provide when you:
- use our Services;
- create an account or profile to use our Services;
- subscribe to a Service, email updates or publications;
- request marketing to be sent to you;
- enter a competition, sweepstakes, promotion or survey; or
- give us feedback or contact us.
Automated technologies or interactions
As you interact with our Services, we will automatically collect Technical and Usage Data about your equipment, browsing actions and patterns. We collect this personal data through your devices, cookies, web beacons, tracking technologies, and other similar technologies, whether implemented by us or a third party. Third parties or publicly available sources
We will receive personal data about you from various third parties and public sources including:
- Technical Data from analytics providers such as Google, advertising networks, and search information providers.
- Identity and Transaction Data from providers of technical, payment and delivery services.
- Identity and Profile Data from data brokers, social media networks, online stores and marketplaces or aggregators.
- Identity and Profile Data where you access our Services using your Facebook or Google credentials.
- Sensitive Personal Data from third party devices and accounts that you enable to connect to your Powderline account.
4. How We Use Your Personal Data
We will use your personal data only for the purposes for which we collect it, unless we reasonably consider that we need to use it for another reason that is compatible with the original purpose. Most commonly, we will use your personal data in the following circumstances:
- Performance of a Contract. Where we need to perform the contract to which you are a party or to take steps at your request before entering into such a contract.
- Legitimate Interest. Where it is necessary for our legitimate interests (or those of a third party) in conducting and managing our business and your interests and fundamental rights do not override those interests.
- Compliance with a Legal Obligation. Where we need to comply with a legal obligation that we are subject to.
Marketing
We may use your Identity, Transaction, Technical, Usage, and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. You will receive marketing communications from us if you have provided your express opt in consent or if you created an account or purchased goods or services from us and you have not opted out of receiving that marketing.
You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at support@powderline.com.
Change of Purpose
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
5. Disclosures of Your Personal Data
In general, your personal data will remain with us, but we may share your personal data with the parties described below.
- Internal Third Parties: other companies in the Powderline group of companies acting as controllers or processors who provide IT and system administration services.
- External Third Parties: service providers including vendors, consultants, professional advisers, regulators and law enforcement, advertising partners, and payment processors.
- Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
6. International Transfers
Powderline operates from various countries around the world, as do our service providers and other third parties to whom we may need to disclose your personal information. This means that when you use or interact with Powderline, your personal information may be transferred to other countries that have different data protection laws than those where you reside.
However, whenever we transfer personal information to other countries, we ensure that the personal information is transferred in accordance with applicable data protection laws and this Privacy Policy. Specifically, when we transfer personal data outside the UK or EEA, we will attempt to ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
- Transfer only to countries deemed to provide an adequate level of protection by the European Commission or UK government.
- Use of specific contracts approved by the European Commission or UK government.
- Specific organizational and technical safeguards to limit and protect personal data transferred.
7. Data Security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
8. Data Retention
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. Specifically, we will retain your Identity Data as long as any account with us remains in force. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
9. Third Party Ad Servers
Our advertising service vendors and other third parties will at times use tracking technologies to serve you advertisements tailored to interests you have shown by using our Services and other sites, applications, destinations, and services you have visited, and for other lawful business purposes. In doing so, these third parties will collect non-personally identifiable data including for example the make, model, settings, specifications and geographic location of your computer, mobile or other device, as well as date/time stamp, IP address, pages visited, time of visits, content viewed, ads viewed, and other clickstream data.
The use of tracking technologies by third parties is subject to their own privacy policies, not this Privacy Policy. If you do not want the services that tracking technologies provide, you may be able to opt-out by visiting http://optout.networkadvertising.org, using script-blockers, and modifying the tracking options in your web browser, phone, computer, or other device or software.
Powderline has partnered with She Media Ad Services, among others, to manage certain programmatic advertising. She Media implements tracking technologies on Powderline's properties.
10. Cookie Policy
A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your computer if you agree. Cookies contain information that is transferred to your computer's hard drive.
We use the following cookies:
- Strictly necessary cookies. These are cookies that are required for the operation of our websites and cannot be switched off in our systems.
- Analytical or performance cookies. These cookies enable the website to recognize and count the number of visitors and to see how visitors move around our websites when they are using it.
- Functionality cookies. These cookies allow the website to provide enhanced functionality and personalization and are used to recognize you when you return to our websites.
- Targeting cookies. These cookies record your visit to our websites, the pages you have visited and the links you have followed.
Please note that third parties may also use cookies, over which we have no control. Except for strictly necessary cookies, which are essential for the Services to function, you can choose which cookies we can set by using our consent management platform. Cookie-based opt-outs must be performed on each device and browser that you wish to opt-out.
11. Your Legal Rights

Annex A: Privacy Information for U.S. Residents
This Annex A is adopted to comply with U.S. comprehensive privacy laws, such as the California Consumer Privacy Act (CCPA) and any terms defined in the applicable privacy laws have the same meaning when used in this Annex A.
1. Sales or Sharing of Personal Information for Cross Context Behavioral or Targeted Advertising
We may sell or share your digital activity information with third parties in order to receive information about the performance of our marketing campaigns and usage statistics related to our sites or applications. This activity may constitute a "sale" or "share" under applicable comprehensive privacy laws.
You may opt-out of the sale or sharing of your information by utilizing one of the options in the Exercising Rights section below or enabling the Global Privacy Control (GPC) on your browsers. 2. Sensitive Personal Information
We do not use or disclose sensitive personal information outside of the permissible uses permitted under the CCPA.
3. Your Rights and Choices
You may have the following rights regarding your personal information:
- Access to Specific Information and Data Portability Rights — the right to request that Powderline disclose certain information to you about our collection and use of your personal information.
- Deletion Request Rights — the right to request that Powderline delete your personal information that we collected from you and retained, subject to certain exceptions.
- Correction Request Rights — the right to request we correct any inaccurate personal information we may hold about you.
- Appeal Rights — the right to appeal a refusal to take action on a request by contacting us at support@powderline.com.
4. Non-Discrimination
We will not discriminate against you for exercising any of your rights.
5. California's "Shine the Light" Law
California's "Shine the Light" law (Civil Code Section §1798.83) permits California residents that have an established business relationship with us to request certain information regarding our disclosure of certain types of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year. Annex B: Privacy Information for UK and EEA Residents
This Annex B is adopted to comply with the General Data Protection Regulation (GDPR) and any terms defined in the GDPR have the same meaning when used in this Annex B.
1. Legal Rights of UK and EEA Residents
Under certain circumstances, you have the following rights under data protection laws in relation to your personal data:
- Request access to your personal data (data subject access request).
- Request correction of the personal data that we hold about you.
- Request erasure of your personal data.
- Object to processing of your personal data where we are relying on a legitimate interest.
- Request restriction of processing of your personal data.
- Request the transfer of your personal data to you in a structured, commonly used, machine-readable format.
- Withdraw consent at any time where we are relying on consent to process your personal data.

2. No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.
3. What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.
4. Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
Annex C: Privacy Information for Powderline Shred Users
This Annex C describes how Powderline processes your information when using Powderline Base™, Powderline Stoke™ and Powderline Shred™.
Powderline Base™, Powderline Stoke™ and Powderline Shred™ provides a feature within the Services that allows users to utilize data-tracking features, including GPS location data, to record ski or snowboard sessions, including trails ridden, top speed attained, and the length of your longest ride. The personal data we collect through Powderline Resort Partner may include:
- Standard Identity Data and Profile Data. Personally identifiable information you provide through our Services, including your name, user ID, email address, zip code, username, and password.
- Usage Data. Sensory and motion data from your mobile device, including information from the location and motion sensing hardware within your device, in order to calculate and detect information about your ride, including the approximate length of rides, estimated maximum speed, and attempted trails. Also includes information about your ride history.
- Technical Data. Device information, including the operating system and device unique identifier (such as IP address or device ID).
- Sensitive Personal Data. Precise location information through the GPS tracker in your mobile device, when you enable location tracking services. Health information, including heart rate and energy data, collected by third party devices and accounts that you consent to sharing with Powderline.
Powderline Shred: How are my Shreds displayed and shared?
Each tracked Powderline Base™, Powderline Stoke™ and Powderline Shred™ session will appear in your Powderline account and will be displayed with relevant usage data such as ride time, ride length, and estimated maximum speed, along with date, time and location of ride. Please note, your Powderline Base™, Powderline Stoke™ and Powderline Shred™ data, including name, location and all other relevant ride information will be accessible through the publicly available link.
